Становлення інституту примирення на території сучасної України у дорадянський період
In recent years, Ukraine has been reforming the judiciary, and much attention has been paid by the legislature and society to the promotion and development of alternative out-of-court peaceful methods of dispute resolution, especially by lawyers, psychologists, sociologists, philosophers, and scholars. The forms, models and types of mediation that are covered in detail are mostly presented in the light of foreign implementation experience, which is quite reasonable, as the use of someone else's experience is usually quite effective. Nevertheless, conciliation procedures in various forms of their implementation have been constantly present at every stage of formation of Ukrainian society, so the historical and legal experience of out-of-court disputeresolution needs thorough consideration and attention as part of the national cultural heritage. As a result, the theoretical and legal basis for the current stage of development of alternative methods of dispute resolution should be developed, first of all, mediation, which is currently given the most attention by both the legislator and society. The generalization of the genesis of conflict resolution mechanisms in primitive society shows that the idea of reconciliation and the application of conciliation procedures was formed at the stage of formation of human civilization, so we can assume that reconciliation is inherent in human nature, mentality and society, and the task of modern society is to improve conciliation mechanisms for constructive conflict resolution and the maintenance of a culture of peaceful conflict resolution. Mankind, even at the stage of the primitive system, sought the relationship of three main forms of conflict and dispute resolution: violent (from the standpoint of force), judicial (from the standpoint of law) and concili- ation (from the standpoint of interests), and we have focused our research on conciliation among the Slavic peoples to trace the formation of the culture and traditions of dispute resolution by the Ukrainian nation. Analysis of the pre-Soviet period of dispute settlement mechanisms shows that conciliation procedures in modern Ukraine have long been inherent in society and embodied in various forms that meet the needs of the time, the subjective composition of the parties to the dispute and the substance of the dispute. At the same time, it is important that the genesis of the formation of conciliation procedures is quite clearly traced both in public, interstate and private disputes. It should also be noted that the terms of amicable agreements, subject to certain conditions, were recognized as law. On the territory of modern Ukraine there were various institutions of recon- ciliation – conscientious, amicable, arbitration, volost, com- mercial courts, mediation commissions, and the state and law encouraged conciliation procedures. ; Протягом останніх років в Україні триває реформа судоустрою та судочинства, багато уваги з боку законодавця та суспільства приділяється популяризації та становленню альтернативних позасудових мирних методів вирішення спорів, особливо увага юристів, психологів, соціологів, філософів, як науковців так і практиків, прикута до розвитку інституту медіації. Форми, моделі та види медіації, які докладно висвітлюються, здебільшого подаються з огляду на іноземний досвід впровадження, що є цілком обґрунтованим, адже використання чужого досвіду зазвичай є доволі ефективним. Тим не менш, примирні процедури у різних формах їх втілення були постійно присутні на кожному етапі становлення українського суспільства, тому історико-правовий досвід позасудового вирішення спорів потребує ґрунтовного осмислення та уваги як частина національного культурного надбання. У результаті мають бути розроблені теоретико-правові основи для сучасного етапу розвитку альтернативних методів вирішення спорів, насамперед, медіації, якій на даний час приділяється найбільша увага як з боку законодавця так і суспільства. Проведене узагальнення генези механізмів вирішення конфліктів у первісному суспільстві свідчить, що ідея примирення та застосування примирних процедур сформувалася ще на тому етапі формування людської цивілізації, тому ми можемо припустити, що примирення є притаманним людській натурі, менталітету та суспільству, а завдання сучасного суспільства полягає в удосконаленні механізмів примирних процедур для конструктивного вирішення конфліктів та підтримання притаманній людині культури мирного вирішення конфліктів. Людство, ще на етапі первісного строю, шукало співвідношення трьох основних форм вирішення конфліктів та спорів: насильницької (з позицій сили), судової (з позицій права) та примирної (з позицій інтересів), тому ми спрямували увагу на формуванні примирних процедур серед слов'янських народів, щоб прослідкувати формування культури та традицій вирішення спорів українською нацією. Аналіз дорадянського періоду становлення механізмів вирішення спорів свідчить, що примирні процедури на території сучасної України здавна були притаманними суспільству та втілюватися у різні форми, які відповідали потребам часу, суб'єктному складу учасників спору та суті спору. При цьому важливим є те, що генеза становлення примирних процедур достатньо чітко прослідковується як щодо публічних, міждержавних спорів, так і щодо приватних. Необхідно також звернути увагу на те, що умови мирових угод за дотримання певних умов визнавалися правом. На території сучасної України існували різні інститути примирення – совісні, мирові, третейські, волосні, комерційні суди, посередницькі комісії, а держава і право заохочували примирні процедури.
